1. Introduction

Welcome to Zoardex ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Zoardex platform, including our website, trading signal services, software, and any related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Risk Acknowledgment & Gambling Disclaimer

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.

You expressly acknowledge and agree that:

  • Prediction markets are a form of gambling. Trading on prediction markets involves wagering money on the outcome of future events. Like all forms of gambling, you may lose some or all of the money you wager.
  • High risk of financial loss. The value of positions in prediction markets can fluctuate rapidly and unpredictably. You may lose your entire investment, and in some cases, you may incur losses exceeding your initial investment.
  • No guaranteed returns. Past performance of trading signals or strategies is not indicative of future results. There is no guarantee that you will profit from using our Service.
  • You are solely responsible for your trades. All trading parameters are set by you. Zoardex provides automated trading via proprietary signals and tools, but you are solely responsible for setting your trade parameters.
  • Only risk what you can afford to lose. You should only trade with funds that you can afford to lose entirely without affecting your financial stability or lifestyle.

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • No liability for financial losses. Zoardex, its affiliates, officers, directors, employees, agents, partners, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, funds, data, or other intangible losses, resulting from your use of the Service.
  • No liability for trading decisions. We are not responsible for any trading decisions you make based on signals, data, or information provided through the Service.
  • No liability for third-party platforms. We are not responsible for any losses incurred on third-party platforms (including but not limited to Polymarket) that you access in connection with our Service.
  • No liability for technical failures. We are not liable for any losses resulting from system failures, delays, interruptions, or errors in signal transmission.
  • Service provided "as is." The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

4. License Grant and Termination

Subject to your compliance with these Terms, Zoardex grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service.

Zoardex reserves the absolute right to revoke, suspend, or terminate your license and access to the Service at any time, with or without cause, with or without notice, at our sole discretion.

Reasons for termination may include, but are not limited to:

  • Violation of these Terms
  • Suspected fraudulent, abusive, or illegal activity
  • Requests by law enforcement or government agencies
  • Discontinuation or modification of the Service
  • Technical or security issues
  • Any other reason at our sole discretion

Upon termination, your right to use the Service will immediately cease. You will not be entitled to any refunds for any fees paid. We shall not be liable to you or any third party for any termination of your access to the Service.

5. Eligibility

By using the Service, you represent and warrant that:

  • You are at least 18 years of age (or the age of majority in your jurisdiction)
  • You have the legal capacity to enter into binding contracts
  • You are not located in a jurisdiction where prediction market trading or gambling is prohibited
  • You are not on any sanctions list or prohibited from using financial services
  • You will comply with all applicable laws and regulations in your jurisdiction

6. Account Security

You are responsible for maintaining the security of your wallet, private keys, API credentials, and license key. You agree to:

  • Keep your credentials confidential and not share them with others
  • Notify us immediately of any unauthorized access or security breach
  • Accept responsibility for all activities that occur under your account

Zoardex is not liable for any losses resulting from unauthorized access to your account due to your failure to maintain security.

7. Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Share, resell, or redistribute your license or access credentials
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to manipulate markets or engage in wash trading
  • Use automated systems to abuse or overload the Service

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Zoardex and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in our Privacy Policy. We collect wallet addresses, trading data, and usage information to provide and improve the Service.

10. Indemnification

You agree to indemnify, defend, and hold harmless Zoardex and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in a class action lawsuit or class-wide arbitration.
